Onleave Terms of Service

Article 1. Purpose

These Terms set out the basic matters concerning the rights, obligations, and responsibilities between Onleave and its members, and the conditions and procedures for use, in connection with the services Onleave provides, including hot-spring information, magazine content, community features, and events (the 'Service').

Article 2. Definitions

Terms used herein are defined as follows.

• ①'Service' means all services Onleave provides through its website regardless of the access device (PC, mobile, etc.), including hot-spring search and browsing, magazine content, community features, event entries, and supplementary features such as likes, bookmarks, and follows.
• ②'Member' means a person who agrees to these Terms and signs up via Kakao or Google account linking (social login) to use the Service.
• ③'Guest' means a person who uses the Service without signing up.
• ④'Account' means the usage credential created through Kakao or Google account linking to identify a Member and enable use of the Service. Onleave does not collect or store passwords of its own.
• ⑤'Content' (posts) means all information and materials a Member publishes on the Service, including text, photos, ratings, and comments.

※ Terms not defined in this Article are interpreted in accordance with applicable laws and general commercial practice.

Article 3. Posting and Amendment of the Terms

• ①Onleave posts these Terms on this page within the Service so that Members can easily review them.
• ②Onleave may amend these Terms to the extent not in violation of applicable Korean laws, including the Act on the Regulation of Terms and Conditions, the Act on Consumer Protection in Electronic Commerce, and the Act on Promotion of Information and Communications Network Utilization and Information Protection.
• ③When amending the Terms, Onleave announces the effective date and reasons together with the current Terms at least 7 days before the effective date. For amendments unfavorable to Members, Onleave announces them at least 30 days in advance and additionally notifies Members individually, such as by email.
• ④A Member who continues to use the Service without expressing refusal by the effective date is deemed to have agreed to the amended Terms. A Member who does not agree may terminate the service agreement (withdraw membership) under Article 15.
• ⑤These Terms are written in Korean, with English, Japanese, and Chinese translations provided. In case of any discrepancy between a translation and the Korean text, the Korean text prevails.

Article 4. Rules Outside These Terms

Matters not stipulated in these Terms and the interpretation of these Terms are governed by applicable laws or by individual policies and guides that Onleave separately establishes and announces.

Article 5. Formation of the Service Agreement

• ①The service agreement is formed when a person wishing to become a Member agrees to these Terms and applies for membership via Kakao or Google account linking, and Onleave accepts the application.
• ②Onleave may refuse to accept, or subsequently terminate, an application that falls under any of the following.

• ·The application uses another person's identity or account
• ·False information is provided, or information requested by Onleave is not provided
• ·The applicant is under 14 years of age
• ·The applicant was previously restricted from use for violating these Terms
• ·The application is otherwise made in an unlawful or improper manner

• ①Onleave may withhold acceptance where service facilities lack capacity or where technical or operational issues exist.
• ②Where acceptance is refused or withheld under paragraph 2, Onleave notifies the applicant in principle.

Article 6. Management of Member Information and Notices

• ①Members may view and edit their information at any time in the 'Profile' menu within the Service.
• ②Members must update their registered information when it changes; Onleave is not responsible for disadvantages arising from a failure to do so.
• ③Members are responsible for managing the Kakao or Google account used for account linking. A Member who becomes aware that a third party is using their account must immediately notify Onleave and follow its guidance.
• ④Individual notices to a Member may be given to the Member's email address; notices to all Members may be substituted by posting within the Service.

Article 7. Protection of Personal Information

Onleave endeavors to protect Members' personal information as required by the Personal Information Protection Act of Korea and related statutes. The processing and protection of personal information are governed by applicable laws and the Privacy Policy that Onleave separately publishes.

Article 8. Obligations of Onleave

• ①Onleave does not engage in acts prohibited by applicable laws or these Terms or contrary to public order and morals, and endeavors to provide the Service continuously and stably.
• ②Onleave maintains a security system to protect personal information so that Members can use the Service safely, and publishes and complies with its Privacy Policy.
• ③Where Onleave recognizes that a Member's opinion or complaint regarding the Service is justified, it handles the matter promptly; where immediate handling is difficult, it informs the Member of the reason and the handling schedule.

Article 9. Obligations of Members

1. Members must not engage in any of the following acts.

• ·Registering false information when applying for membership or changing information
• ·Misappropriating another person's information or account
• ·Infringing intellectual property rights, including copyrights, of Onleave or third parties
• ·Defaming Onleave or third parties or interfering with their business
• ·Posting information contrary to public order and morals, such as obscene material or violent, discriminatory, or hateful messages
• ·Posting or transmitting for-profit advertising without Onleave's prior consent
• ·Collecting the Service or its information without authorization using automated means such as crawlers or bots, imposing load on servers, or reverse-engineering the Service
• ·Intentionally interfering with the normal operation of the Service
• ·Any other act that violates applicable laws or is otherwise improper

2. Members must comply with applicable laws, these Terms, usage guides, precautions announced in connection with the Service, and matters notified by Onleave.

Article 10. Provision and Change of the Service

1. Onleave provides Members with the following services.

• ·Hot-spring search and browsing
• ·Magazine and other content services
• ·Community services (stories, questions and answers, comments, ratings, etc.)
• ·Event announcements and entries
• ·Supplementary features such as likes, bookmarks, and author follows
• ·Any other services Onleave additionally develops or provides through partnerships

• ①The Service is in principle provided 24 hours a day, year round, but may be restricted or suspended under Article 11.
• ②Onleave may change or discontinue all or part of the Service for operational or technical needs where there is a reasonable cause. Changes or discontinuations that are unfavorable or material to Members are announced in advance within the Service.
• ③Except where applicable laws specifically provide otherwise, Onleave does not separately compensate Members in connection with changes to or discontinuation of services provided free of charge.

Article 11. Restriction and Suspension of the Service

• ①Onleave may temporarily suspend all or part of the Service for unavoidable reasons such as regular or emergency maintenance, equipment failure or repair, communication outages, natural disasters, or national emergencies.
• ②For suspensions under paragraph 1, Onleave gives advance notice within the Service. Where advance notice is impossible due to causes beyond Onleave's control, notice is given without delay afterwards.
• ③Absent willful misconduct or gross negligence, Onleave is not liable for damages incurred by Members due to a suspension under paragraph 1.

Article 12. Copyright in Member Content

• ①Copyright in content a Member posts on the Service belongs to that Member.
• ②The Member grants Onleave a royalty-free, non-exclusive license to use the content (including reproduction, transmission, display, resizing, and simple editing) within the scope of operating, displaying, improving, and promoting the Service. If Onleave wishes to use content commercially beyond this scope, it obtains the Member's prior consent.
• ③Content a Member does not delete before withdrawing may remain on the Service in a state where the author cannot be identified. If you want it removed, delete it before withdrawing or request removal via the contact address.
• ④Members warrant that their content does not infringe third-party rights, including copyright; civil and criminal liability arising from content is borne by the posting Member.

Article 13. Management of Content

• ①Where a Member's content violates applicable laws, the rights holder may request suspension of posting, deletion, and similar measures under the procedures prescribed by law, and Onleave takes necessary measures such as interim measures in accordance with applicable laws, including Article 44-2 of the Act on Promotion of Information and Communications Network Utilization and Information Protection.
• ②Even absent a rights holder's request, Onleave may take interim measures such as deletion or unpublishing, without prior notice, against content for which there is reasonable ground to recognize infringement or which violates the prohibited acts in Article 9 or other Onleave policies. In such cases Onleave notifies the Member of the fact and reasons afterwards.
• ③A Member may object to measures under paragraph 2 via the contact address; where the objection is recognized as justified, Onleave restores the content without delay.

Article 14. Paid Services and Fees

• ①All services Onleave currently provides are free of charge; no usage fees or commissions of any kind are charged to Members. No auto-billing (recurring subscription) products exist.
• ②If Onleave introduces paid services in the future, it will clearly disclose, before providing the service, the fees, payment methods, refund standards (including the right of withdrawal under the Act on Consumer Protection in Electronic Commerce of Korea), whether auto-billing applies, and renewal and cancellation procedures, and will provide the service only after obtaining the Member's explicit consent.
• ③Members will never be charged without the disclosure described in paragraph 2.

Article 15. Termination and Restriction of Use

• ①Members may request termination of the service agreement (membership withdrawal) at any time via the withdrawal function in the 'Profile' menu or the contact address, and Onleave processes it without delay as required by applicable laws.
• ②Upon withdrawal, the Member's personal information is destroyed in accordance with the Privacy Policy, and content the Member did not delete is handled under Article 12, paragraph 3.
• ③If a Member violates these Terms or applicable laws, Onleave may take measures in stages according to the severity of the violation: warning, content deletion, temporary suspension, permanent suspension, and termination of the agreement.
• ④When taking a restriction measure under paragraph 3, Onleave notifies the Member in advance of the reason, duration, and objection procedure. However, where unavoidable — such as when urgent prevention of danger or harm to others is required — Onleave may take the measure first and notify without delay afterwards.
• ⑤A Member may object to a restriction measure via the contact address after receiving notice; where the objection is recognized as justified, Onleave immediately resumes the Member's use of the Service.

Article 16. Limitation of Liability (Disclaimer)

• ①Onleave is exempt from responsibility for providing the Service where it cannot do so due to natural disasters or comparable force majeure.
• ②Onleave is not liable for Service disruptions attributable to the Member.
• ③Onleave does not guarantee the reliability or accuracy of information, materials, or facts posted by Members or third parties, and, absent willful misconduct or gross negligence, is not liable for damages arising therefrom.
• ④Information on the Service about hot springs — such as operating hours, prices, facilities, and water quality — is reference material to assist your decisions and may differ from actual conditions depending on local circumstances. We recommend confirming with the facility directly before visiting; absent willful misconduct or gross negligence, Onleave does not guarantee its accuracy or completeness.
• ⑤Onleave has no obligation to intervene in disputes arising between Members, or between a Member and a third party, through the medium of the Service, and, absent willful misconduct or gross negligence, is not liable for damages therefrom.
• ⑥In connection with the use of services provided free of charge, Onleave's liability is limited except where applicable laws specifically provide otherwise.

Article 17. Damages

• ①If Onleave or a Member causes damage to the other party by violating these Terms, the violating party is liable for that damage, except where there is no intent or negligence.
• ②If a Member's violation of these Terms causes damage to Onleave, or Onleave receives a damages claim, lawsuit, or other objection from a third party due to the Member's violation, the Member must indemnify and hold Onleave harmless at the Member's own cost and responsibility, and must compensate Onleave for any damage not so indemnified.

Article 18. Dispute Resolution, Governing Law, and Jurisdiction

• ①Where a dispute arises between Onleave and a Member, both parties first endeavor to resolve it amicably through mutual consultation.
• ②Where consultation under paragraph 1 fails, the Member may apply for mediation with a dispute-mediation body under applicable Korean laws, such as the Content Dispute Resolution Committee under the Content Industry Promotion Act or the Consumer Dispute Mediation Committee under the Framework Act on Consumers.
• ③Disputes relating to these Terms and use of the Service are governed by the laws of the Republic of Korea, and where litigation is brought after paragraphs 1 and 2 fail to resolve a dispute, jurisdiction is determined by the Civil Procedure Act of Korea.
